Please read these Terms & Conditions (“Terms”) carefully before using the website and services provided by Berthelot’s Farm & Lab (“Company,” “we,” “our,” or “us”). By creating an account, placing an order, or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Berthelot’s Farm & Lab provides DNA testing services for poultry and related species. Our services include specimen analysis, result reporting, and certificate generation based on samples submitted by customers. All testing is performed using PCR-based methodologies.
To place orders and access test results, you must create a customer account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must be at least 18 years of age to create an account and use our services.
We reserve the right to suspend or terminate accounts that violate these Terms, contain fraudulent information, or remain inactive for an extended period.
All orders are placed through our website. Prices are displayed at the time of order and are subject to change without notice. Volume discounts and promotional pricing may be available and are applied automatically at checkout when applicable.
Once an order is placed and payment is confirmed, you will receive a Batch Identification Number and mailing instructions for submitting your samples.
Payment is required at the time of order placement. We accept payment via credit/debit card (processed through Stripe) and PayPal. All prices are listed in US dollars.
By saving a payment method to your account, you authorize us to store a secure token provided by the payment processor for future transactions. We do not store your actual card or account numbers.
Customers are responsible for properly collecting, labeling, and shipping samples in accordance with the instructions provided on our Sample Collection page. Each sample must be clearly labeled with the specimen identifier matching your online order, and your Batch Identification Number must be written on the outside of the mailing envelope.
We are not responsible for samples that are lost, damaged, or delayed in transit. We recommend using a trackable shipping method.
Improperly collected, labeled, or packaged samples may result in delays, the need for re-collection, or the inability to produce results. If a sample is insufficient or contaminated, we will notify you and request a replacement sample at no additional charge for the testing itself. The customer is responsible for any shipping costs associated with re-collection.
While our PCR-based DNA testing delivers over 99% accuracy when performed on a properly collected sample, no testing method is 100% guaranteed. Results are provided as professional determinations based on the sample received and the testing methodology employed.
Berthelot’s Farm & Lab is not liable for breeding decisions, purchasing decisions, sales representations, or any other actions taken based on test results. Test results do not constitute a guarantee of any kind regarding the specimen.
Test results are delivered through your secure online customer dashboard. You will receive an email notification when your results are available.
Results and certificates are accessible through your dashboard for a limited retention period following release. The current retention period is 30 days. You will receive a reminder notification prior to results expiring. We strongly encourage you to download your certificates and save your results promptly.
After the retention period, results may no longer be accessible through the dashboard. Berthelot’s Farm & Lab is not obligated to restore access to expired results.
Upon completion of testing, a certificate may be generated for each specimen containing the test results, specimen information, and order details. Certificates are available for viewing and download through your dashboard during the retention period.
Certificates are provided for informational purposes and represent the results of testing performed on the submitted sample. They do not constitute a warranty or guarantee regarding the specimen.
Cancellation by Customer: You may cancel an order before testing has begun (i.e., while the order status is “Paid,” or “Awaiting Samples”). To request a cancellation, contact us or use the cancellation option in your account. A reason for cancellation is required.
Cancellation by Company: We reserve the right to cancel an order at any time if we are unable to process the samples, if payment cannot be verified, or for any other reason at our discretion. You will be notified and a full refund will be issued.
Refunds: For orders cancelled before testing begins, a full refund will be issued to the original payment method. For orders paid via credit card or PayPal, refunds are processed through the original payment gateway. Refunds may take 5–10 business days to appear depending on your financial institution.
No refunds will be issued for orders where testing has already begun, except in cases where we are unable to produce results due to an error on our part.
All content on our website – including text, images, logos, graphics, and software – is the property of Berthelot’s Farm & Lab or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
You agree not to use our website or services to:
To the fullest extent permitted by law, Berthelot’s Farm & Lab, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or services, including but not limited to loss of revenue, loss of data, or loss of business opportunities.
Our total liability for any claim arising from or related to our services shall not exceed the amount you paid for the specific testing service giving rise to the claim.
You agree to indemnify, defend, and hold harmless Berthelot’s Farm & Lab, its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from your use of our website or services, your violation of these Terms, or your violation of any third-party rights.
Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Louisiana.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Berthelot’s Farm & Lab regarding your use of our website and services, and supersede any prior agreements or communications.
We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of our website and services after changes are posted constitutes your acceptance of the revised Terms.
